The United States Supreme Court ruled in favor of the state of Texas in a suit brought by the Lone Star state to reinstate the “Remain in Mexico” policy for asylum-seekers, according to The Washington Free Beacon.
According to the Free Beacon’s report the Biden Administration failed to show reasons for ending the program as the law required.
The act, formally known as the Migrant Protection Protocols, is a policy concerning migrants seeking asylum in the United States that forces them to stay outside the United States while their application is reviewed.
This act was put into place due to the extraordinary number of applicants who didn’t return to the court for their mandated hearing, many of whom are never seen by immigration officials unless they are arrested and forced to appear.
A judge in the Fifth U.S. Circuit Court of Appeals said the Homeland Security Department was unable to justify why the program should be terminated.
This after the Biden Administration terminated President Donald Trump’s move to ensure that those seeking permanent residence in the United States would work their way through the legal channels.
“In recent years, this Court has repeatedly stayed broad lower court injunctions against executive branch policies addressing matters of immigration, foreign policy, and migration management. It should do the same here,” the filing from acting solicitor general Brian Fletcher reads.
Texas filed a lawsuit case is No. 21A21 Biden v. Texas after Homeland Security Secretary Alejandro Mayorkas rescinded the Migrant Protection Protocols on June 1.
