SCOTUS blocks OSHA vaccine mandate in serious blow to Biden

Delivering yet another staggering blow to an administration that is falling apart at the seams, the U.S. Supreme Court on Thursday blocked implementation of President Joe Biden’s vaccine-or-test mandate for private businesses with 100 or more employees, as Fox News reports.

A majority of the high court found that the Occupational Safety and Health Administration (OSHA), the federal agency Biden charged with formulating and enforcing the rules for business enterprises, had exceeded its statutory authority, but in a separate case, upheld a rule promulgated by the Centers for Medicare and Medicaid services that requires jabs for employees at health care facilities that receive federal funds.

In invalidating the OSHA rule, the court determined that while the agency has been legislatively empowered to set safety standards in the workplace, it does not possess the authority to enact sweeping public health measures which would, in this case, impact roughly 84 million individuals without any sort of industry-specific risk analysis.

“Although COVID-19 is a risk that occurs in many workplaces, it is not an occupational hazard in most,” declared the majority, adding, “COVID-19 can and does spread at home, in schools, during sporting events, and everywhere else that people gather. That kind of universal risk is no different from the day to day dangers that all face from crime, air pollution, or any number of communicable diseases.”

Not surprisingly, the outcome in the challenge to the OSHA mandate sent progressives reeling and amplified their ongoing demands for the court to be expanded from its current composition of nine justices to, presumably, make way for a slate of liberal nominees selected by Biden and negate the existing conservative tilt on the panel.

Liberal activist and former adviser to Hillary Clinton, Brad Woodhouse, took to Twitter to express his outrage, saying “Republicans want to prolong the pandemic – have more people get sick and die – so they can blame Biden and win an election. And the Supreme Court just helped them. Disgraceful.”

Radical advocacy group Occupy Democrats reacted to the high court’s split decision by observing, “Once again, we see the conservative Trump-stacked court endangering the American people. RT IF YOU THINK IT’S TIME FOR BIDEN TO STACK THE COURT!”

Far-left legal commentator for The Nation, Elie Mystal, did not miss a chance to vent his spleen on the matter, saying, “Remember when I said that the Supreme Court would stop the entire Biden agenda and so reforming the Supreme Court should be his number 1 priority and he said he’d make a ‘commission to study it.’ And reform was left to die? THIS IS WHY WE FAIL.”

George Washington University law professor Jonathan Turley aptly suggested on Thursday that Biden’s defeat on the OSHA mandate is evidence of a broader administration recklessness and that “it shows a radicalism in policy, that they kind of go as radical as possible…and then the court has to come in and say, ‘Not so fast,’” and fortunately, at least in part, a majority of justices did just that.
