Federal judge lifts Biden administration’s public transportation mask mandate

In a ruling cheered by pandemic-weary travelers everywhere, Trump-appointed U.S. District Court Judge Kathryn Kimball Mizelle lifted the Biden administration’s requirement that masks be worn on modes of public transportation such as trains and airlines, as Fox News reports.

In Judge Mizelle’s estimation, the mandate – promulgated by the Centers for Disease Control and Prevention (CDC), stood in violation of the Administrative Procedure Act in that it exceeded the agency’s authority, adding that it was “arbitrary,” “capricious,” and was not put through necessary federal notice and comment procedures.

Though the mask mandate on airlines was poised to expire on several different occasions throughout the duration of the pandemic, the administration just extended it for another two weeks before Judge Mizelle’s decision was issued.

According to the Daily Mail, numerous posters on social media on Monday shared videos of travelers celebrating the news by tearing off their face masks and cheering their newfound freedom.

One passenger wrote, “I’m on Delta flight to NYC now and the plane absolutely went bonkers when Captain said NO NEED TO WEAR A MASK ON THIS FLIGHT. We are taking our country back!!!”

Not surprisingly, it did not take long for authoritarian, mask-obsessed liberals to voice their considerable outrage over the end of the mandate, with writer Charlotte Clymer lamenting the new state of affairs, saying, “Sitting for several hours in a tight, enclosed space with 200 coughing, breathing, sneezing strangers? Yeah, I’m gonna keep wearing my mask on flights for the foreseeable future, and that’s all I have to say about that.”

Mark Joseph Stern of Slate took aim directly and personally at the judge who nixed the left’s beloved mask rule, writing, “Mizelle’s alleged qualification for the bench? Her clerkships with conservative judges. That was enough for Senate Republicans. Now she’s issuing nationwide injunctions that affect millions of Americans’ health and safety. No sane democracy would permit this system of governance.”

Adding to the grossly hypocritical tone from the left in the wake of Mizelle’s decision, Massachusetts legislator Lindsay Sabadosa declared, “[n]o matter how you feel about masks, you should be really, really concerned that the Courts are effectively taking away power from the federal government,” revealing a startling ignorance of the American system of checks and balances.

Though millions of frequent fliers – and users of public transportation in all forms – felt a sense of jubilant relief upon hearing the news that the mask mandate was no more, The Justice Department announced late on Tuesday that it would appeal Mizelle’s ruling pending an opinion from the CDC stating that the order remains necessary in the interest of public health. Mercifully, a stay on the decision will reportedly not be sought, leaving travelers free to travel bare-faced as litigation proceeds.
