Alleged rapist who caused 10-year-old to become pregnant in prominent abortion rights case was illegal immigrant

It was arguably the most widely shared story about how overturning Roe v. Wade would lead to unthinkable results: A 10-year-old Ohio girl, impregnated by a rapist, had to cross state lines to obtain an abortion.

However, the bad publicity has flipped back on the Democrats and the Biden administration: According to Fox News, the man who allegedly raped the 10-year-old was an illegal immigrant. 

The Columbus Dispatch originally reported that 27-year-old Gerson Fuentes had been arrested in the case, which had drawn national attention.

Police say he confessed to raping the 10-year-old at least twice.

He was arrested Tuesday and charged with first-degree felony rape.

The case was reported internationally after the Indianapolis Star reported that the girl traveled to Indiana three days after Roe v. Wade was overturned to abort the baby.

Ohio had banned all abortions after six weeks and the girl was six weeks and three days pregnant, the Star reported.

“Imagine being that little girl,” President Joe Biden said when remarking on the case. “I’m serious. Just imagine being that little girl.”

While many tried to cast doubt on the provenance of the story, there were several other factors which made the original narrative problematic.

As Ohio Attorney General Dave Yost pointed out, “Ohio’s heartbeat law has a medical emergency exception broader than just the life of the mother. This young girl, if she exists, and if this horrible thing actually happened to her — breaks my heart to think about it — she did not have to leave Ohio to find treatment.”

Furthermore, the alleged rapist turns out to be an illegal immigrant — a serious issue for the Biden administration as it is, which has seen record numbers of migrants at the southern border.

The administration has also dramatically reduced enforcement actions on illegal immigrants inside the United States.

In a statement, Immigration and Customs Enforcement confirmed Fuentes was in the country illegally.

“On July 13, officers with U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations lodged an immigration detainer on Gerson Fuentes following his arrest by the Columbus, Ohio Police Department for felony rape charges. Fuentes is currently in the custody of local officials at the Franklin County Jail,” an ICE spokesperson said. “Fuentes has no previous immigration history.”

ICE has placed a detainer — or a request that an individual be turned over to the agency for removal proceedings — on Fuentes,.

In addition, the doctor who initially leaked the story of the young girl’s rape now faces a Health Insurance Portability and Accountability Act, or HIPAA, violation for violating her privacy.
